Legal Basement Apartment Contractor in Toronto & York Region

Legal basement apartments, second units and in-law suites planned to the Ontario Building Code, with permits and inspections coordinated with you.

What Makes a Basement Apartment Legal

A second unit is legal when it meets the rules and is permitted.

Ontario allows second units in many houses. The Province explains the basics on its Add a second unit in your house page. A second unit (also called a secondary suite, basement apartment, in-law suite or additional residential unit) must meet the Ontario Building Code, fire safety rules and the local zoning by-law, and it needs a building permit.

In Toronto, the City has a Secondary Suites permit guide that lists the drawings and forms required. In Richmond Hill, Ontario, Canada, the City explains its rules on the Additional Residential Unit page. AVL Custom Homes plans the work with these rules from the start, prepares the drawings with the design professionals the project needs, and coordinates the permit application and inspections with you. Approval is always decided by the City.

Who It Is For

Second units for family, rental income or future flexibility.

In-Law Suites

A private space for parents or grown children, with its own kitchen, bathroom and entrance.

Rental Basement Apartments

A self-contained unit built to the rules, so you can rent it with the right permits in place.

Converting an Existing Basement

Review of an existing finished basement to see what must change to become a legal unit.

Egress Windows and Entrances

New or enlarged window openings and separate basement entrances, included in the permit drawings.

Legal Basement Requirements

The main requirements for a legal basement apartment

The exact rules come from the Ontario Building Code, the Ontario Fire Code and your City's zoning by-law, and they change over time, so every project is checked against the current official rules. These are the areas a second unit is usually reviewed on:

Ceiling height

Minimum clear heights apply to rooms and to areas under beams and ducts; low basements may need a different layout.

Egress from bedrooms

Each bedroom needs a window or door that meets the Code's size and height rules for emergency exit.

Fire separation

Fire-rated separation between the units, plus interconnected smoke and carbon monoxide alarms.

Separate entrance and exits

A safe path in and out of the unit, which may be a side, rear or shared entrance.

Heating, ventilation and plumbing

Systems must serve both units safely; shared ductwork often needs changes such as smoke dampers or separate systems.

Zoning and parking

Your City's zoning by-law sets rules such as parking and entrance location for additional residential units.

Legal basement permits in Richmond Hill and Toronto

Each City runs its own permit process. In Richmond Hill, Ontario, Canada, second units are called Additional Residential Units and are applied for through the City's building permit process. In Toronto, the City's Secondary Suites guide lists the drawings and forms. We serve Toronto, Richmond Hill, Markham, Vaughan, Thornhill and the rest of York Region from our office at 50 East Wilmot St, Unit 208, Richmond Hill.

After the Renovation

A finished basement needs regular checks for moisture, sump pumps, and heating and ventilation. The AVL Annual Home Maintenance Plan keeps the whole house, including the basement, on a regular care schedule.

FAQ

Common Questions

What makes a basement apartment legal in Ontario?

It must meet the Ontario Building Code and fire safety rules, comply with the local zoning by-law, and be built under a building permit with the required inspections. The Province summarizes this on its second unit page.

Do I need a permit for a legal basement in Richmond Hill or Toronto?

Yes. Toronto lists adding a second suite as work that requires a building permit (When do I need a building permit), and Richmond Hill states that additional residential units require a building permit (City of Richmond Hill). Electrical work also needs an ESA permit. AVL coordinates these with you; the City and ESA decide on approval.

Do I need an egress window for a basement bedroom?

Bedrooms in a second unit need a way to get out in an emergency that meets the Ontario Building Code, usually a window or door of a required size. Many existing basement windows are too small, so a new or enlarged opening is often part of the work. We check this on the first visit.

How much does a legal basement apartment cost?

Cost depends on the current state of the basement, whether egress windows or a separate entrance are needed, fire separation, plumbing and kitchen work, heating and ventilation, electrical work, drawings and permit fees, and the finishes. AVL gives a written quote after the feasibility visit rather than a generic range.

How long does it take to create a legal basement apartment?

It depends on the design, the permit review time, the construction scope and the inspection schedule. We give you a project-specific schedule once the scope is set.

Can every basement become a legal second unit?

No. Ceiling height, egress, zoning, parking, entrances and the existing structure can limit what is possible. A feasibility visit tells you whether your basement is a good candidate before you spend on design.

I had a great experience working with AVL Custom Homes on our full home renovation, including the kitchen remodel. Ali managed the project and helped coordinate the work from start to finish. Renovations can be stressful, but I appreciated having someone overseeing the process and keeping things organized.

The kitchen transformation made a big difference in our home, and I'm really happy with how everything turned out. The before-and-after photos show just how much the space changed.

After working with AVL on the renovation, I also signed up for their Annual Home Maintenance Plan. I wanted to keep my home in good condition and have a reliable team I could turn to for ongoing maintenance, rather than waiting for problems to arise.

I'm happy with the work AVL Custom Homes did and would recommend them to homeowners looking for renovation services and ongoing home maintenance.

Got the Gold Plan with AVL Custom Homes about 4 months ago. I wanted to wait and see if it was actually worth it before leaving a review.

We ended up having some random issues around the house recently, and Ali literally took care of everything. He dealt with the contractors directly, coordinated everything, and got the issues fixed so we didn't have to deal with the headache ourselves.

The reports they send are great, and they actually do what they promised. Having someone who knows the house, keeps track of things, and takes care of issues when they come up has given us a lot of peace of mind.

Definitely recommend AVL if you want reliable home maintenance and someone you can actually count on.

After several poor experiences with unreliable contractors, I was referred to AVL Custom Homes and immediately noticed a difference in their professionalism and technical expertise. Ali and his team consistently identify issues accurately and propose practical, cost-effective solutions.

I started with their Oversight Plan and later upgraded to the Concierge Plan after seeing their reliability, even for small issues and in difficult weather. Along with higher-level service, it brings real peace of mind for a busy homeowner. Based on this experience, I have also entrusted them with the maintenance of my office. I would recommend AVL Custom Homes to anyone seeking dependable and professional property oversight.

We recently signed up for the Gold Plan with AVL Custom Homes, and the first 'House Condition Report' was eye-opening. While scanning the house with a thermal camera, the team discovered a hidden leak in an exterior wall caused by a faulty roof downspout. We had no idea this issue existed for years!

The level of detail Ali and his team put into the deep inspection was impressive. It’s clear they truly care about the long-term health of the homes they manage. I highly recommend this service to any homeowner who wants professional, deep-dive maintenance and real peace of mind.

We hired AVL Custom Homes to manage and complete a full house renovation, including our kitchen, bathrooms, and flooring. From the start, they were easy to work with and very organized. Communication was clear, and we always knew what was happening next.

We also chose them for project management, and that turned out to be the right decision. Scheduling and coordination were handled smoothly, and the accounting was very transparent. As with any renovation, there were some unexpected costs, but everything was clearly explained in advance and there were no hidden charges. Ali was very knowledgeable and took the time to explain issues and suggest practical, cost-effective solutions when challenges came up.

Overall, the project was well managed from beginning to end, and we are very happy with the final result. We would recommend AVL Custom Homes to anyone looking for a reliable company to handle a full home renovation.
